This privacy policy explains how we collect, use, store, share and protect personal information when you use our services or visit our platforms. We comply with the Nigeria Data Protection Act 2023 and other applicable data protection laws. Our lawful basis for processing your data may be based on the performance of a contract we have with you, your consent, our legitimate business interests or compliance with legal obligations.

Data we collect

We collect personal data such as your name, age, residential address, national identification details (including BVN and NIN), email address, mobile number, bank account or card details, and other information needed to create an account and satisfy Know Your Customer requirements. We also collect transaction information when you send or receive money, purchase airtime or pay bills, including transaction amounts, merchant information and device and geolocation data. In addition, we may collect details about participants in your transactions with your consent, such as your phone contacts, to enable you to transact easily. We may collect images or biometric data for identity verification and KYC purposes, and log/technical data such as IP address, browser type, device identifiers and usage statistics.

How we collect data

We collect personal data directly from you when you register for a FUSTPAY account, use our services, fill out forms, contact our customer support team, respond to surveys or participate in promotions. We may also collect personal data about you from third-party sources such as credit bureaus, fraud prevention agencies, identity verification providers and other publicly available sources to comply with regulatory requirements.

How we use data

We use your personal data to create and manage your FUSTPAY account, authenticate your identity, process payments and transfers, and deliver services such as bank transfers, airtime and data purchases. We use your data to manage risk, detect and prevent fraud, comply with legal and regulatory obligations, resolve disputes and troubleshoot problems. We may communicate with you about your account, send transaction notifications and service updates, and, with your consent, send marketing communications and targeted offers. We also use data analytics to improve our services, develop new features and enhance user experience.

Data retention

We retain personal data only for as long as necessary to fulfil the purposes for which it was collected and to meet our legal, accounting or reporting obligations. Subject to applicable laws, we will retain your personal data for the duration of your relationship with FUSTPAY and thereafter as required by law or regulation.

Sharing your data

We may share your personal data with other entities within our corporate group, third-party service providers, financial institutions and payment processors who perform services on our behalf, such as verifying your identity, processing transactions or providing customer support. We may also share data with transaction counterparties (such as other users and their service providers) to facilitate a transfer. Where required by law or for the prevention of fraud or other crimes, we may disclose information to law enforcement agencies, regulators, courts or other government authorities. We ensure that any third parties processing your data implement appropriate security measures.
