FUSTPAY services are intended for individuals who are at least 18 years old and have the legal capacity to enter into a contract. We do not knowingly allow individuals under the age of eighteen to use our services, and you may be required to confirm your age before registration.

To use FUSTPAY, you must create an account, provide a valid mobile phone number and accurate personal information, and complete any required Know‑Your‑Customer checks, including providing your Bank Verification Number and other identification. You agree to keep your login credentials and PIN confidential and are responsible for all activity conducted through your account. We may require two‑factor authentication for additional security and reserve the right to decline or suspend an account if regulatory requirements are not met.

FUSTPAY is a digital payment platform that allows users to transfer money from their FUSTPAY wallet to bank accounts in Nigeria, purchase airtime, data subscriptions and other value‑added services. These services may involve third‑party providers such as telecommunications companies. When you purchase third‑party products, you do so under that provider’s terms and conditions and FUSTPAY is not responsible for the quality, accuracy or delivery of those products.

You agree to use FUSTPAY only for lawful purposes and in compliance with all applicable laws and regulations. You must not use the platform to violate or infringe the rights of any person or to conduct fraudulent activities such as money laundering, fraud, terrorist financing or any other illegal act. FUSTPAY reserves the right to block or suspend your account without liability if we suspect unauthorised or illegal use and may report suspicious activity to law enforcement or regulatory authorities.

FUSTPAY may charge fees for certain transactions, including transfers to bank accounts and purchases of airtime or data. All applicable fees will be disclosed within the app before you complete a transaction. Third‑party fees and taxes may also apply. Fees are subject to change, and we will notify you of material changes through the app or our website.

You may not use FUSTPAY for activities that are prohibited by law or industry regulations. Prohibited activities include, but are not limited to, gambling, the sale of weapons, controlled substances, counterfeit goods, cryptocurrencies or Ponzi schemes, bribery, fraud, money laundering, unregulated charities, shell banks, or any deceptive, unfair or predatory practice. FUSTPAY adopts similar restrictions to those set out in industry‑standard merchant agreements and may decline transactions or close accounts that violate these rules.

FUSTPAY implements reasonable security measures to protect your account and personal data. However, you are responsible for keeping your devices and software secure and for enabling measures such as two‑factor authentication. We process personal data in accordance with our privacy policy and will not sell or rent your personal information. By using our services, you consent to the collection and use of your data as described in that policy.

All content on the FUSTPAY platform—including text, logos, graphics and software—is owned by FUSTPAY or its licensors. You are granted a limited, non‑exclusive, non‑transferable and revocable licence to use the platform in accordance with these terms. You may not copy, reproduce, modify, distribute or create derivative works based on our platform or materials without our prior written consent.

FUSTPAY provides its services on an “as is” and “as available” basis and does not warrant that the services will meet your requirements or be error‑free. To the maximum extent permitted by law, FUSTPAY will not be liable for any indirect, incidental, special or consequential damages arising out of your use of the platform. Our total liability to you for any claims relating to the services will not exceed the total fees you have paid to us in the six months preceding the event giving rise to the liability.

You agree to indemnify and hold harmless FUSTPAY, its affiliates, employees and partners from any claims, losses, liabilities or expenses (including legal fees) arising from your breach of these terms, your violation of any law or rights of a third party, or any fraudulent or illegal use of your account.

We may suspend or terminate your access to FUSTPAY at any time if you breach these terms, engage in fraudulent or unlawful conduct, or we are required to do so by law or by a regulatory authority. Where practicable we will provide prior notice, but we may act without notice where immediate suspension is necessary to prevent fraud or comply with legal requirements. Upon termination, any rights granted to you under these terms will cease.

FUSTPAY reserves the right to amend these terms at any time. We will notify you of material changes via the app, our website or email. By continuing to use the services after changes take effect, you agree to be bound by the revised terms.

These terms and your use of FUSTPAY are governed by the laws of the Federal Republic of Nigeria. Any dispute arising under these terms that cannot be resolved amicably will be submitted to mediation in Lagos, Nigeria. Nothing in this clause prevents FUSTPAY from seeking injunctive relief in a competent court to protect its intellectual property or to comply with regulatory obligations.

Referral Program – FUSTPAY offers a referral program that rewards users for inviting others to use our services. Participation in the referral program is optional and subject to the following subsections.
